1. Acceptance of Terms

By using the PropDescriptions (the "Service"), you agree to be bound by these terms and conditions (the "Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. You may not use the Service if you are located in a country or territory subject to an Australian embargo or trade sanctions, or if you have been designated as a Specially Designated National or Blocked Person by the Australian Office of Financial Sanctions Implementation.

3. Account Creation and Use

To use the Service, you must create an account and provide us with certain information, such as your name, email address, and password. You must keep your account information accurate and up-to-date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

4. Use of the Service

You may use the Service to generate property descriptions for your own personal or commercial use. You may not use the Service to generate property descriptions for any third party without their express consent. You may not use the Service to generate property descriptions that are false, misleading, or deceptive.

5. Intellectual Property

PropDescriptions owns all intellectual property rights in and to the Service, including its underlying technology, software, and content. You are granted a non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6. Third Party Integration Errors and Downtime

PropDescriptions is not liable for any issues relating to third party integration errors or downtime.

7. Termination

PropDescriptions may terminate your account or suspend your access to the Service at any time for any reason, without notice or explanation.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, PROPDESCRIPTIONS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF PROPDESCRIPTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law principles.

10. Entire Agreement

These Terms constitute the entire agreement between you and PropDescriptions with respect to the subject matter hereof and supersede all prior or contemporaneous communications and representations, whether oral or written.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.

12. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both parties.

13. Cancellation

Individual users can cancel their account at any time. Corporate or enterprise users must contact sales to cancel their account.

14. Non-Payment

If you fail to make a payment for the Service on time, your account may be suspended. If your account is suspended, you will not be able to use the Service. To reactivate your account, you must pay all outstanding fees and charges. You are liable for all outstanding fees and charges, even if your account is suspended. PropDescriptions may take collection action against you to recover any outstanding fees and charges.

15. Changes to Terms

PropDescriptions may update these Terms from time to time. If PropDescriptions makes any material changes to these Terms, PropDescriptions will notify you by email or by posting a notice on PropDescriptions' website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

16. Credentials Sharing Prohibition: User is strictly prohibited from sharing, disclosing, or otherwise permitting access to their PropDescriptions account or login credentials with any third party, including but not limited to friends, family members, or colleagues. Sharing access, including sharing passwords, is expressly forbidden.

Account Holder Responsibility: Account Holder is responsible for any activity conducted under their account, whether by the Account Holder personally or by any third party granted access through password sharing.
Notification of Unauthorised Access: If the Account Holder suspects or becomes aware of any unauthorised access or use of their account, they must immediately notify the Platform provider to take appropriate action to secure the account.

Enforcement and Consequences

i. Account Termination: Violation of this Condition may result in the immediate suspension or termination of the User's account, at the sole discretion of PropDescriptions.

ii. Legal Action: The Platform provider reserves the right to take legal action against Users who engage in password sharing that results in unauthorised access or misuse of the Platform.

Agreement to Condition

By accessing or using the Platform, User affirms their understanding of and consent to this Condition, and they agree to abide by it. Failure to comply with this Condition may lead to account termination and other legal remedies.

17. Payment Consent

By subscribing to PropDescriptions, you hereby authorise PropDescriptions to send instructions to the financial institution that issued your card to take payments from your card account in accordance with the terms of your agreement with us. This authorisation is binding and will remain in effect until written notice is provided to revoke it, or the subscription is cancelled. You understand that these payments will be processed in accordance with the terms and conditions outlined in your agreement with PropDescriptions.
